Facts: Charlie paid $2000 a month for child support and add-ons as ordered in the divorce judgment. Then he lost his job and found a new job paying less money. Charlie felt that he could no longer pay the stipulated amount.

Action: Action: His wife brought an enforcement action to collect what was owed to her under the divorce judgment.Charlie separately filed a petition to reduce his child support.

Result: The court agreed to reduce Charlie’s child support obligations starting from the date he filed the petition because he showed that he didn’t take his new lower paying job to avoid his child support responsibilities.

Case Study: Dead-beat Dad

Facts: The judge stipulated that Judy get five support payments of $250,000 each over five years. Henry paid the first two years of support. He then stopped his payments without offering any reason.

Action: Judy filed a child support enforcement proceeding to recover the unpaid money she is entitled to. Henry was unable to justify his non-payment.

Result: Henry was ordered to make the remaining payments plus other additional costs due to his late payments.
